These Terms and Conditions set out the basis on which Waste Disposal Kennington provides waste collection and disposal services to domestic and commercial customers. By placing a booking, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the individual, business or organisation requesting or receiving waste collection or disposal services from Waste Disposal Kennington.
Services means any waste collection, removal, transportation, recycling or disposal service provided by Waste Disposal Kennington.
Booking means a confirmed request by the Customer for Services, whether made by telephone, email, online form or any other agreed method.
Waste means any items, materials, refuse, rubbish or goods presented for collection as part of the Services.
Hazardous Waste means any waste that is classed as hazardous or special waste under applicable UK legislation and regulations.
Waste Disposal Kennington provides waste collection and disposal services for households, landlords, letting agents, offices, shops and other premises within our operational service areas. The specific Services to be provided will be agreed at the time of Booking based on the information you provide.
We may offer one-off collections, scheduled collections, bulky waste removal, garden waste removal, and other related waste management services. Not all services are available in all areas at all times. We reserve the right to modify, withdraw or add to the range of Services offered without prior notice.
3.1 Bookings can be made by telephone, email or online request form, where available. When making a Booking, you must provide accurate and complete information about:
a. The type and approximate quantity or volume of Waste to be collected.
b. The collection address, including any access restrictions, parking limitations or congestion issues.
c. Any time constraints or preferred collection windows.
d. Any Waste that may be hazardous, restricted or subject to special handling requirements.
3.2 All Bookings are subject to availability and to acceptance by Waste Disposal Kennington. We are not obliged to accept any request for Services.
3.3 Once we have confirmed the Booking, either verbally or in writing, a contract will be formed between you and Waste Disposal Kennington on these Terms and Conditions.
3.4 You are responsible for ensuring that the details of your Booking are correct. If the information you provide is incomplete or inaccurate, we may be unable to complete the Services, or additional charges may apply.
4.1 You must ensure that our team has safe, suitable and unobstructed access to the collection point at the agreed time. This includes arranging any parking permissions, permits or access codes in advance, where necessary.
4.2 Waste should be ready for collection at the agreed time. Any requirements for dismantling, carrying from upper floors, or removal from difficult locations must be disclosed at the time of Booking.
4.3 You must not present for collection any items or materials that are prohibited by law, or that you do not have the legal right to dispose of. By using our Services, you confirm that you are the owner of the Waste or have full authority from the owner to arrange its removal.
4.4 If access is impossible, significantly delayed, unsafe or not as described at the time of Booking, we may cancel or postpone the visit and apply a call-out or wasted journey charge.
5.1 Waste Disposal Kennington operates in compliance with applicable UK waste management legislation and regulations, including duty of care requirements for the storage, transport and disposal of controlled Waste.
5.2 Certain types of Waste cannot be collected or require prior arrangement, including but not limited to:
a. Hazardous Waste such as chemicals, solvents, asbestos, clinical or medical waste, gas bottles and some electrical items.
b. Items containing ozone-depleting substances or other controlled materials.
c. Explosive, highly flammable, radioactive or otherwise dangerous materials.
5.3 If you present any Waste of this nature without prior agreement, we may refuse to collect it, or if it is discovered after loading, we may charge additional fees for its safe handling and disposal.
5.4 We reserve the right to refuse to handle any Waste which, in our reasonable opinion, is unsafe, illegal, excessively heavy, contaminated, infested or likely to cause damage or harm.
5.5 Waste Disposal Kennington will use licensed facilities for transfer, recycling and disposal of Waste in accordance with environmental regulations. Wherever reasonably possible, we will seek to divert Waste from landfill through reuse and recycling.
6.1 Prices for our Services may be based on the volume of Waste, the weight of Waste, the time taken on site, the nature of the items collected, access conditions, and any disposal charges.
6.2 Any quotations provided prior to collection are estimates only and are based on the information you provide. If on arrival the Waste is materially different in volume, type or difficulty from what was described, we may revise the price before proceeding.
6.3 Where possible, a final price will be agreed on site before work begins. If you do not agree to any revised price, we may cancel the Service for that visit. A call-out charge may apply if we have travelled to the site and are unable to carry out the work due to incorrect information or non-disclosure.
7.1 Payment terms will be confirmed at the time of Booking. For most residential and small commercial customers, payment is due at the time of collection or in advance.
7.2 We may accept payment by cash, card or bank transfer, subject to availability and confirmation at the time of Booking. We reserve the right to require full or partial payment in advance.
7.3 For approved account customers, payment shall be due within the agreed credit terms from the date of invoice. If no alternative terms are agreed, payment is due within 30 days of the invoice date.
7.4 If you fail to make payment on time, we reserve the right to charge interest on overdue amounts at the statutory rate, and to recover any reasonable costs of debt collection, including legal fees.
7.5 We may suspend or refuse to provide further Services until all outstanding amounts have been settled in full.
8.1 If you wish to cancel or amend a Booking, you must notify us as soon as possible by telephone or email.
8.2 Cancellations made more than 24 hours before the scheduled collection time will usually not incur a cancellation fee, unless otherwise stated at the time of Booking.
8.3 Cancellations or significant amendments made less than 24 hours before the scheduled collection time may be subject to a cancellation charge, which may include any costs we have already incurred in relation to your Booking.
8.4 If our team attends the site at the agreed time and is unable to carry out the Service for reasons within your control, including lack of access or Waste not being available, a call-out or wasted journey fee may be charged.
8.5 We reserve the right to cancel or reschedule a Booking in the event of circumstances beyond our reasonable control, such as vehicle breakdown, severe weather, staff illness, traffic disruption, or compliance with legal obligations. In such cases, we will endeavour to notify you as soon as reasonably practicable and arrange an alternative time.
9.1 We will carry out the Services with reasonable care and skill and in accordance with applicable health and safety requirements.
9.2 Collection times are approximate and may be subject to change due to traffic, operational issues or unforeseen circumstances. Time is not of the essence in relation to performance of the Services.
9.3 The Customer or an authorised representative should be available at the collection address during the agreed time window to provide access and confirm the items to be removed. If no one is available, we may proceed only if prior arrangements have been made and agreed.
10.1 Once the Waste has been loaded onto our vehicle and payment terms have been satisfied, ownership and responsibility for the Waste will pass to Waste Disposal Kennington, except where the Waste is later found to be prohibited or unlawfully presented.
10.2 If any collected items are later identified as stolen property, illegally dumped material, or items that you did not have the right to dispose of, we may cooperate with law enforcement and may seek to recover any costs or losses incurred.
11.1 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded by law.
11.2 Subject to the above, Waste Disposal Kennington shall not be liable for:
a. Any indirect, special or consequential losses, including loss of profit, loss of business, or loss of opportunity.
b. Any damage to property or fixtures arising from pre-existing defects, structural weaknesses, poor installation, or conditions that could not reasonably have been foreseen.
c. Any loss resulting from delays, cancellations or failure to perform caused by events beyond our reasonable control.
11.3 Our total aggregate liability to you in respect of any claim arising out of or in connection with the Services, whether in contract, tort or otherwise, shall not exceed the total amount paid or payable by you for the specific Services giving rise to the claim, except where a higher limit is required by law.
11.4 You are responsible for removing or protecting any items of value or fragile objects which might be at risk during collection. We will take reasonable care but cannot accept liability for minor scuffs, marks or incidental damage that may arise from moving large or bulky items in confined spaces, unless caused by our negligence.
12.1 You agree to indemnify and hold harmless Waste Disposal Kennington from and against all claims, losses, damages, liabilities, fines, penalties, costs and expenses arising out of or in connection with:
a. Your breach of these Terms and Conditions.
b. Any inaccurate or misleading information provided in connection with a Booking.
c. Any Waste presented for collection that is illegal, hazardous, prohibited, or which you do not have the right to dispose of.
13.1 We will collect and process personal information about you only as necessary to manage your Booking, provide the Services, handle payments, and comply with legal obligations.
13.2 Your details may be retained for administration, accounting and record-keeping purposes. We will take reasonable steps to keep your information secure and will not sell your details to third parties.
13.3 We may share relevant information with our staff, contractors, payment processors, insurers and regulatory authorities where necessary for the provision of Services or to comply with legal requirements.
14.1 If you are dissatisfied with any aspect of our Services, you should notify us as soon as possible, providing details of the issue and supporting information where available.
14.2 We will investigate complaints in a fair and timely manner and aim to reach a reasonable resolution. This may include a partial refund, re-performance of the Services, or another form of remedy, where appropriate and proportionate.
14.3 Raising a complaint does not entitle you to withhold payment of undisputed amounts owed.
15.1 Waste Disposal Kennington may update or amend these Terms and Conditions from time to time. The version in force at the time of your Booking will apply to that Booking.
15.2 Any changes intended to apply to ongoing or scheduled Services will be notified to you where reasonably practicable.
16.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.
17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.
17.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Services, or any contract formed under them.
By making a Booking with Waste Disposal Kennington or using our waste collection and disposal services, you confirm that you have read, understood and agree to be bound by these Terms and Conditions.
